This Privacy Policy explains how Sparq Health (“Sparq Health,” “we,” “us,” or “our”) collects, uses, discloses, and protects your information when you use our telehealth services, visit our website, or communicate with us — including via text message. By using our services, you agree to the practices described in this policy.

We recommend consulting with your own legal counsel to ensure compliance with applicable federal and state laws relevant to your specific circumstances.

1. Information We Collect

1.1 Information You Provide Directly

  • Full name, date of birth, gender, and contact information (phone number, email address, mailing address)

  • Health history, symptoms, medications, allergies, and related medical information

  • Payment and billing information (processed securely through third-party payment processors)

  • Communications you send us via email, chat, phone, or text message

  • Photos, documents, or lab results you submit for clinical review


1.2 Information Collected Automatically

  • IP address, browser type, operating system, and referring URLs

  • Pages visited, session duration, clicks, and navigation patterns on our website

  • Device identifiers and cookies (see our Cookie Policy below)


1.3 Information From Third Parties

  • Laboratory and diagnostic results from partner testing facilities

  • Pharmacy and prescription fulfillment records

  • Health records transferred with your authorization from other providers

2. How We Use Your Information

We use the information we collect to:

  • Provide, coordinate, and improve our telehealth services and clinical care

  • Process payments and manage your account

  • Communicate with you about your care, including appointment reminders, lab results, and follow-up instructions

  • Send you SMS text messages for which you have opted in (see Section 5)

  • Operate our website and improve user experience

  • Meet legal obligations and respond to lawful requests from regulatory authorities

3. How We Share Your Information

We do not sell your personal information. We share your information only in the following limited circumstances:


3.1 Service Providers

We work with third-party vendors who help us operate our business — including payment processors, electronic health record (EHR) platforms, pharmacy fulfillment partners, and IT service providers. These vendors are contractually obligated to protect your data and use it only to perform services on our behalf.


3.2 Clinical Partners

We may share your health information with pharmacies, laboratories, or other licensed healthcare providers involved in your care — but only as necessary to provide treatment and only with your knowledge.


3.3 Legal and Regulatory Requirements

We may disclose your information when required by law, court order, or government regulation, or when we believe disclosure is necessary to protect the rights, safety, or property of Sparq Health, our patients, or the public.


3.4 Business Transfers

In the event of a merger, acquisition, or sale of all or a portion of Sparq Health's assets, patient information may be transferred as part of that transaction. We will notify you via email or a prominent notice on our website before your information becomes subject to a different privacy policy.


3.5 SMS Messaging — Important Notice

All the above categories exclude text messaging originator opt-in data and consent. This information will not be shared with any third parties, affiliates, or partners for marketing or promotional purposes. Mobile opt-in consent is not sold, rented, or transferred under any circumstances.


4. HIPAA and Health Information

As a telehealth provider, Sparq Health handles Protected Health Information (PHI) in accordance with the Health Insurance Portability and Accountability Act (HIPAA). We maintain administrative, physical, and technical safeguards designed to protect the privacy and security of your health information.

You have the right to:

  • Access and receive a copy of your health records

  • Request corrections to inaccurate information

  • Receive an accounting of certain disclosures of your PHI

  • Request restrictions on how your PHI is used or disclosed

  • Receive a copy of our HIPAA Notice of Privacy Practices

5. Text Message (SMS) Communications

By providing your mobile phone number and opting in to our SMS program, you consent to receive text messages from Sparq Health. These messages may include:

  • Appointment confirmations, reminders, and follow-up care instructions

  • Lab result notifications and clinical updates

  • Account and billing alerts

  • Health information and program updates for which you have specifically opted in


Consent to receive text messages is not a condition of receiving any service from Sparq Health.

Standard message and data rates may apply depending on your mobile carrier and plan. Message frequency varies based on your care plan and communication preferences.

To opt out of text messages at any time, reply STOP to any message. To request assistance, reply HELP. See our Terms & Conditions for complete opt-out instructions.

Mobile opt-in data and consent information are never shared, sold, or transferred to third parties or affiliates for any marketing or promotional purposes.

6. Cookies and Tracking Technologies

Our website uses cookies and similar tracking technologies to improve your browsing experience and analyze site traffic. Cookies are small text files stored on your device.

We use:

We use industry-standard security measures to protect your information, including encrypted data transmission (SSL/TLS), secure access controls, and regular security assessments. However, no system is completely secure. We encourage you to protect your account credentials and notify us immediately at hello@joinsparqhealth.com if you believe your information has been compromised.

9. Children's Privacy

Sparq Health's services are intended for adults aged 18 and older. We do not knowingly collect personal information from individuals under the age of 18. If we learn we have inadvertently collected information from a minor, we will promptly delete it. 10. Your Privacy Rights

Depending on your state of residence, you may have additional rights regarding your personal information, including:

These Terms and Conditions (“Terms”) govern your use of Sparq Health's telehealth services, website (www.sparqhealth.com), and SMS messaging program. By accessing our services, scheduling a consultation, or opting into our communications, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree, do not use our services.

1. About Sparq Health

Sparq Health is a telehealth practice founded by Danielle Brandt, FNP, MSCP — a nurse practitioner with 23+ years of experience specializing in hormone health, longevity, and proactive disease prevention. Sparq Health provides telehealth consultations, personalized treatment plans, and prescription services to patients across participating states.

Sparq Health operates as a licensed healthcare provider and is subject to applicable federal and state laws governing telehealth, prescribing, and patient privacy.

2. Eligibility

You must be at least 18 years of age to use Sparq Health's services. By using our services, you represent that you are 18 or older and that all information you provide is accurate and complete. Sparq Health reserves the right to refuse service to anyone who provides inaccurate information or who does not meet eligibility requirements.

3. Telehealth Services

3.1 Nature of Services

Sparq Health provides telehealth-based clinical consultations, lab interpretation, hormone health management, weight loss support, peptide therapy oversight, and other services as described on our website. All clinical services are provided by licensed nurse practitioners or other licensed healthcare providers.


3.2 Not a Substitute for Emergency Care

Sparq Health's services are not intended for medical emergencies. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately. Do not use our messaging or appointment systems for urgent or life-threatening situations.


3.3 No Guarantees of Outcomes

Individual results vary. Sparq Health makes no guarantee of specific health outcomes. Clinical decisions are made based on your individual health information and the professional judgment of your provider.


3.4 Medication and Prescription Services

Where appropriate and clinically indicated, licensed providers at Sparq Health may prescribe medications, including compounded hormones and peptides, which are shipped directly to your door through licensed pharmacy partners. Prescription services are subject to applicable state laws and are available only where permitted.

4. Testing Policy

4.1 Lab Work Requirements

Many Sparq Health treatment protocols require baseline and ongoing lab work to ensure safe, effective, and personalized care. Required testing varies by service and individual health status, and will be discussed with you during your consultation.


4.2 How Testing Works

  • Lab orders are issued by your Sparq Health provider following your initial consultation

  • You may complete required labs at a local draw site using a Sparq Health requisition, or through at-home collection kits where available

  • Results are reviewed by your provider and incorporated into your personalized treatment plan

  • Certain treatments cannot be initiated or continued without current lab results on file


4.3 Ongoing Monitoring

Patients receiving hormone replacement therapy (HRT), testosterone replacement therapy (TRT), peptide therapy, or weight loss medications are required to complete follow-up lab panels at intervals determined by their provider. These panels are essential for your safety and for making accurate dosage adjustments.

Failure to complete required monitoring labs may result in a pause or discontinuation of your treatment plan until updated results are on file.


4.4 Lab Costs

Sparq Health may facilitate lab orders through affiliated or partner laboratories. The cost of laboratory testing may or may not be covered by your insurance or membership plan and will be disclosed to you in advance. Sparq Health is not responsible for third-party laboratory billing or insurance reimbursement decisions.

5. SMS Messaging Program

5.1 Program Name and Description

Program Name: Sparq Health SMS Program

Program Description: Sparq Health sends text messages to opted-in patients and prospective patients for appointment reminders, clinical follow-up, lab result notifications, account alerts, and informational health content.


5.2 Consent

By providing your mobile phone number and opting in — whether via our website intake form, a text keyword, or verbal/written consent — you agree to receive recurring text messages from Sparq Health at the number you provide. Consent is not a condition of receiving services.


5.3 Message Frequency

Message frequency varies. You may receive up to 10 messages per month, depending on your care plan and active communications. During active treatment periods, message frequency may increase.


5.4 Message and Data Rates

Message and data rates may apply. Sparq Health is not responsible for any charges incurred by your mobile carrier for sending or receiving text messages. Contact your carrier for rate details.


5.5 Opt-Out Instructions

To stop receiving text messages from Sparq Health at any time, reply STOP to any text message we send you. You will receive one final confirmation message and will then be removed from our messaging list. To re-enroll, text START to the same number or contact us directly.


5.6 Help

5.7 Carrier Liability

Carriers are not liable for any delayed or undelivered messages. Message delivery is subject to network availability and carrier policies outside of Sparq Health's control.


5.8 Privacy of SMS Consent Data

Mobile opt-in data and messaging consent are not shared, sold, or transferred to any third party or affiliate for marketing or promotional purposes. For full details, see our Privacy Policy at www.sparqhealth.com/privacy.

6. Payments and Refunds

All fees for Sparq Health services are disclosed prior to purchase. Fees may include consultation fees, membership or subscription fees, prescription costs, and laboratory fees. By enrolling, you authorize Sparq Health to charge the payment method on file for applicable fees.

Refund eligibility is determined on a case-by-case basis. Consultations that have been conducted are generally non-refundable. Prescription and compounded medication orders that have been dispensed and shipped are non-refundable. Contact hello@joinsparqhealth.com with any billing concerns.

7. Intellectual Property

All content on the Sparq Health website — including text, graphics, logos, educational materials, and program content — is the property of Sparq Health and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use our content without prior written permission.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Sparq Health, its founders, employees, and affiliated providers shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability to you for any claim shall not exceed the total amount paid by you to Sparq Health in the three (3) months preceding the claim.

Nothing in these Terms limits our liability where such limitation is prohibited by law, including in cases of clinical negligence.

9. Governing Law and Disputes

These Terms are governed by the laws of the State of MA, without regard to conflict of law principles. Any dispute arising from these Terms or your use of Sparq Health's services shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Massachusetts in accordance with the rules of the American Arbitration Association, except where prohibited by law.

10. Changes to These Terms

Sparq Health reserves the right to modify these Terms at any time. We will notify you of material changes via email or a notice on our website. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.
